What is FMLA?

FMLA, also known as the Family and Medical Leave Act, is a federal law that protects employees by making it mandatory for employers with 50 employees or more to provide up to 12 weeks of unpaid job protection and benefits. This law has been benefiting employees who suffer from mental or physical illnesses get the time they need to recover as well as for them to be there for family members and loved ones who also need assistance. For an employee to be eligible for FMLA leave, they must be employed at their organization for at least 12 months as well as worked a minimum of 1,250 hours during that time. Employees are able to use 12 weeks of job-protected leave under any of the following circumstances:

  • Taking care of their own health conditions that deter them from being able to perform their job.
  • Needing to take care of a loved one’s serious health condition such as a spouse, child, parent, or anyone that is like a family member to the employer that is approved.
  • Birth of a child or placement of a child in foster care or adoption.
